Not that Joy Division might have done this, but I’m pretty sure that Disney would sue any band who used their image of Mickey in this manner. Why should fair use continue to apply to them if they don’t think it exists for anyone else?
(Though yes, I know the difference between a trademark and copyright, though Mickey is under both, and think that this is fair use of Joy Division’s image. Also I’m sure someone else bought all this stuff when Factory went under, so who knows owns it.)
